I'm wondering as it's leds and mirrors, is it possible to damage the eye if the
    mirrors are off?

Just as with the 3DS, improper alignment can tire the eyes, and repeated constant eye fatigue can damage the muscles in and around the eye. There is no instant damage, just a chance for repetitive strain.

    I think it's cumulative.

I personally believe a properly aligned unit can cause damage, as a can most devices that cause eyes to go out of focus and such

Besides eye strain, you'll also lose the 3D effect.
My question is what did you do to the poor thing to misalign the lens in the first place?

If it's anything like my 3DS then it will cause a massive headache. Get that thing fixed so you don't get a migrane. They aren't fun when you keep playing through it...
